Welcome to Sonja Illustrated e.U.
These Terms of Service (“Terms”) govern your use of our website and online shop and your purchase of goods from us.

By accessing our website, browsing our content, or placing an order, you agree to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Refund & Return Policy, which form an integral part of these Terms.

If you do not agree with these Terms, you should not use our website or purchase products from us.

3. Scope of Application

These Terms apply to all contracts concluded via our online shop between:

• Sonja Illustrated e.U. (the “Seller”, “we”, “us”), and

• you as a customer (the “Customer”, “you”).

If you are a consumer within the meaning of Directive 2011/83/EU and Austrian consumer law, additional statutory rights apply and are not limited by these Terms.

 

4. Use of the Website

The content on this website is provided for general information and inspiration. It may be changed, updated, or removed at any time without notice.

We do not guarantee that:

• the information is free from errors or omissions,

• the website will be available at all times and without interruption,

• or that the content is suitable for any particular purpose.

Your use of any information or materials on this website is at your own risk. It is your responsibility to ensure that any products, services, or information available through this website meet your requirements.

Misuse of this website (including attempts to gain unauthorised access, scraping, or automated copying of content) is prohibited.

 

5. Products, Images & Descriptions

We offer, among other things:

• art prints,

• greeting cards and card sets,

• notebooks,

• apparel / artwear (e.g. sweatshirts),

• and related artistic merchandise.

We make every effort to describe products and display colours accurately. However:

• colours may appear differently on different screens or devices,

• minor variations in size, colour, or finish may occur due to printing or production processes.

All product descriptions, prices, and availability are subject to change at any time without notice. We reserve the right to:

• modify or update product details,

• discontinue products,

• limit the quantities available.

 

6. Ordering & Conclusion of Contract

1. By placing an order on our website, you make a binding offer to purchase the products in your shopping cart.

2. After you submit your order, you will receive an automatic order confirmation email. This confirms that we have received your order but does not yet constitute acceptance of your offer.

3. A binding purchase contract is concluded only when we:

   • send a separate order acceptance / shipping confirmation, or

   • dispatch the goods and notify you accordingly.

We reserve the right to refuse an order for legitimate reasons, including but not limited to:

• product unavailability,

• payment issues,

• suspicion of fraud or misuse.

 

7. Prices, Shipping Costs & VAT

All prices displayed on the website are final prices (gross), without VAT, as we are exempt under the Austrian small business regulation (§ 6 Abs. 1 Z 27 UStG).

Additional costs:

• Shipping costs are shown during checkout and depend on the product type and destination.

• For shipments outside the EU, customs duties, import taxes, or local charges may apply. These are not included in our prices and must be paid by you upon import/delivery.

We reserve the right to adjust prices at any time. The price applicable to your order is the price displayed at the time of checkout.

 

8. Payment

We accept the payment methods indicated on our website and during checkout (e.g. credit/debit cards, PayPal, Klarna, or other Shopify-supported methods).

• Payment is generally due immediately upon placing the order.

• Your card or account will be debited in accordance with the terms of your payment provider and our payment gateway.

• We are not responsible for any additional fees (e.g. bank charges, currency conversion fees) charged by your payment provider.

If payment cannot be processed, we may cancel the order.

 

9. Shipping & Delivery

We currently ship primarily to Austria, Germany, and other European countries.
The available shipping destinations and exact shipping costs are displayed at checkout.

Estimated delivery times (as an example):

• Austria: approx. 4–5 business days

• Germany: approx. 10 business days

• Europe: approx. 10 business days

These delivery times are estimates only and may vary due to:

• postal delays,

• customs procedures,

• strikes, holidays, or other circumstances beyond our control.

You will receive a shipping confirmation and, where available, a tracking number once your order has been dispatched.

If a package cannot be delivered due to incorrect address information provided by you or failure to collect the parcel, additional shipping costs may apply for re-shipment.

 

10. Retention of Title

All goods remain the property of Sonja Illustrated e.U. until full payment of the purchase price and all associated costs has been received.

 

11. Consumer Right of Withdrawal (Cancellation)

If you are a consumer residing in the EU/EEA, you have a statutory right of withdrawal (cancellation) for distance contracts.

11.1 Withdrawal Period

You have the right to cancel your purchase within 14 days without giving any reason.
The withdrawal period is:

• 14 days from the day on which you or a third party named by you (other than the carrier) takes physical possession of the goods.

11.2 Exercising Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us clearly (e.g. by e-mail) that you wish to cancel the contract:

You may use the EU model withdrawal form (optional), but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification before the 14-day period has expired.

11.3 Effects of Withdrawal

If you withdraw from the contract:

• We will refund all payments received from you, excluding the cost of returning the goods (unless otherwise stated in our Refund & Return Policy),

• without undue delay and in any event no later than 14 days from the day on which we receive the returned goods or proof you have sent them back,

• using the same payment method you used for the original transaction, unless we agree otherwise.

We may withhold the refund until we have received the goods back or you have provided evidence that you have returned the goods, whichever is earlier.

11.4 Return of Goods

You must send back the goods to the address provided in our return instructions:

• without undue delay, and

• in any event no later than 14 days from the day on which you communicate your withdrawal.

You bear the direct cost of returning the goods, unless otherwise stated.

11.5 Condition of Returned Goods

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods (e.g. beyond what you would do in a shop).

The goods must be returned:

• unused,

• undamaged,

• and, where reasonably possible, in their original packaging.

11.6 Exclusions from Withdrawal

The right of withdrawal does not apply to:

• custom-made or personalised items created according to your specifications,

• items which are clearly tailored to your personal needs,

• certain sale or clearance items as indicated.

12. Defects, Warranty & Customer Service

Your statutory warranty rights under Austrian and EU consumer law apply.

If a product is defective or not as described:

• please contact us as soon as possible at sonja@sonjaillustrated.com,

• and provide your order number, a description of the issue, and, if possible, photos of the defect.

We will review your claim and, where justified, remedy the issue in accordance with applicable law (e.g. repair, replacement, price reduction, or refund).

 

13. Data Protection

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Austrian data protection laws.

14. Intellectual Property & Use Restrictions

14.1 Ownership of Content

All content published and made available on our site, including but not limited to:

• text,

• logos,

• graphics,

• illustrations, artworks, prints,

• images and photos,

• design and layout,

• video and audio clips,

• digital files,

• website design and code,

and all associated intellectual property rights are the exclusive property of Sonja Illustrated e.U., its affiliates, or its licensors.

The artworks, including all prints and digital images offered for sale, are original works created by Sonja and are protected under international copyright laws, conventions, and agreements.

14.2 Permitted Use

You may:

• browse the website,

• purchase products for personal use,

• download or print content only for personal, non-commercial purposes,

• share links to our website or products (without copying the artwork/content itself), provided this is done fairly and lawfully.

14.3 Prohibited Use (General)

Without prior written permission from Sonja Illustrated e.U., you may not:

• copy, reproduce, redistribute, republish, upload, post, transmit, or distribute any material from this site, in whole or in part, in any form,

• use the artworks or content for commercial purposes (e.g. on merchandise, in advertising, as logos, etc.),

• remove or alter any copyright, watermark, or attribution notices,

• create derivative works or adaptations of the artworks for commercial use.

14.4 Explicit Prohibition of AI Training & Generative Use

You and any third parties or services acting on your behalf are strictly prohibited from using any content from Sonja Illustrated e.U. (including but not limited to artworks, illustrations, images, text, and designs) for:

• the development, training, fine-tuning, testing, or operation of any machine learning, deep learning, or artificial intelligence (AI) systems,

• use in any generative AI tool or model,

• inclusion in training datasets, benchmarking datasets, or data corpora,

• any form of retrieval-augmented generation, embedding, or feature extraction for AI models.

This prohibition applies regardless of:

• whether the content was obtained from our website, social media, printed goods, or any other medium,

• and whether the AI system is proprietary, open-source, or provided by a third party.

Any such unauthorised use constitutes a material breach of these Terms and a violation of our intellectual property rights and may result in legal action.

15. Copyright Infringement Notifications

If you believe that your intellectual property rights have been infringed by content on our website, please notify us as soon as possible by e-mail:

1. A detailed description of the copyrighted work or right you claim has been infringed;

2. A clear description of where the allegedly infringing material is located on our website;

5. A statement that the information in the notification is accurate, and that you are authorised to act on behalf of the owner of the right allegedly infringed.

We will review such notices and take appropriate action where necessary.

 

16. Limitation of Liability

We are liable without limitation for:

• damages arising from injury to life, body, or health caused by our negligence, and

• damages caused intentionally or by gross negligence.

In all other cases, and to the extent permitted by applicable law, our liability is limited to typical and foreseeable damages and excludes liability for:

• indirect or consequential losses,

• loss of profit,

• data loss not caused by gross negligence or intent.

Nothing in these Terms affects your statutory consumer rights.

 

17. Governing Law & Jurisdiction

These Terms and any contracts concluded via our online shop are governed by the laws of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer, the mandatory consumer protection laws of your country of residence remain unaffected.

For business customers (B2B), the exclusive place of jurisdiction is the Commercial Court of Vienna, Austria. For consumers, the statutory jurisdictions and rules for dispute resolution apply.
